This notice explains how Fábio Miguel Coelho Alves, trading as Elemento Sports Management (“Elemento”), collects, uses and protects personal information.

1. Who is responsible for your information

The data controller is Fábio Miguel Coelho Alves, trading as Elemento Sports Management.

2. Information we may collect

Depending on your relationship or enquiry, Elemento may process:

  • identity and contact information;
  • professional, sporting, career and club information concerning players, coaches and football personnel;
  • contractual, financial, registration and due-diligence information where relevant to representation, recruitment or a transfer;
  • correspondence and records of discussions;
  • parent or guardian information where an enquiry or service concerns a minor; and
  • limited technical information processed by website hosting and security services when you visit the site.

3. How and why we use information

Elemento may use personal information to:

  • respond to enquiries and take steps before entering into an agreement;
  • provide football representation, recruitment, transfer and advisory services;
  • assess sporting suitability and communicate with relevant parties in the football market;
  • manage professional relationships, mandates and contractual matters;
  • maintain appropriate business records and protect legal rights; and
  • comply with applicable law and relevant professional, regulatory or governing-body requirements.

The principal lawful bases are the performance of a contract or steps requested before a contract, Elemento’s legitimate interests in operating and protecting its football business, and compliance with legal obligations. Where another lawful basis is required, it will be identified and applied as appropriate.

Elemento does not make decisions producing legal or similarly significant effects solely by automated means.

4. Who we may share information with

Where necessary and proportionate, information may be shared with:

  • authorised members of the Elemento team, scouts and consultants;
  • clubs, players, coaches, authorised agents and other relevant football counterparties;
  • professional advisers, governing bodies and regulators;
  • providers of hosting, email, communications, document and other business services; and
  • public authorities where disclosure is legally required.

Information is shared only where relevant to an enquiry, relationship, mandate, legal requirement or authorised professional purpose. Elemento does not sell personal information.

5. International transfers

Elemento works across international football markets. Information may therefore be shared with relevant recipients or processed by service providers outside the United Kingdom. Where UK data-protection law requires safeguards for an international transfer, Elemento will use an applicable adequacy arrangement, contractual safeguard or other lawful mechanism.

6. Information concerning minors

Where Elemento processes information concerning a minor, it does so only for a legitimate football or representation purpose and involves a parent, guardian or other authorised adult where required. Minors should not send unnecessary personal or contractual information without the involvement of an appropriate adult.

7. How long we keep information

Elemento retains personal information only for as long as reasonably necessary for the purpose for which it was collected. Relevant factors include the nature of the enquiry or professional relationship, continuing football-market relevance, contractual and regulatory requirements, record-keeping obligations and applicable limitation periods. Information that is no longer required is deleted or securely disposed of.

8. Your rights

Depending on the circumstances, you may have rights to access, correct or erase your information, restrict or object to its use, and receive certain information in a portable format. These rights are not absolute and exemptions may apply.

9. Website, cookies and external services

Elemento does not currently use advertising or analytics cookies on this website. The hosting and security infrastructure may use technologies that are strictly necessary to deliver and protect the site.

Links to WhatsApp, Instagram and LinkedIn lead to services operated by third parties. Their own privacy information applies when you use those services.
